1. Conclusion of the contract:
The presentation of the products on by-mava.com does not constitute a legally binding offer, but merely serves as a non-binding online catalog. By clicking on 'Order now for a fee' at checkout, you are placing a binding order for the products contained in your shopping cart. An order confirmation follows immediately after sending the order, but this does not constitute acceptance of the contract.
Promotional offers additions from the retailer/system error in checkout
If the retailer offers discounts or free goods when purchasing, which are kept by the customer but are returned to other goods, the retailer is entitled to charge the additional price for the promotional product because the conditions of the offer have not been met. In the event of any system errors, we reserve the right to revoke the contract/orders at any time due to system errors.
2. Cancellation policy / right of cancellation
You have the right to cancel this contract within fourteen days without giving any reasons. The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the goods. If the goods are returned/returned due to undeliverability or other reasons, we allow ourselves to charge a shipping fee of 2CHF. In order to exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, fax or email). In order to meet the cancellation period, it is sufficient that you send the notification of your exercise of the right of cancellation before the cancellation period expires.
Consequences of revocation
If you cancel this contract, we will have to pay you all payments received from you, *including delivery costs (except for any additional costs arising from you choosing a method of delivery other than the cheapest standard delivery offered by us have chosen), immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this repayment we use the same payment method that you used for the original transaction, unless something different was expressly agreed with you; under no circumstances will you be charged any fees as a result of this repayment. We may refuse repayment until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever is the earlier. You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you notify us of your cancellation of this contract. The deadline is met if you send the goods before the fourteen day period has expired. *You bear the direct costs of returning the goods. You are only liable for any loss in value of the goods if this loss in value is due to the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
3. Exclusion/extinction of the right of withdrawal:
A right of withdrawal does not apply to contracts for the delivery of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or that are clearly tailored to the personal needs of the consumer and it expires prematurely for contracts for the delivery of sealed goods , which are not suitable for return for health protection or hygiene reasons if their seal has been removed after delivery.
4. Warranty:
If delivered items have obvious material or manufacturing defects, including transport damage, please report such defects to us immediately by email with a photo to info@by-mava.com or to the employee of the transport service provider who delivers the items.
5. Delivery conditions
Shipping costs may apply in addition to the stated product prices. You can find out more about any shipping costs that may apply in the offers.
We only deliver by mail. Unfortunately, a self collection of the product is not possible.
6. Payment
The following payment methods are generally available to you in our shop:
Credit card
When you submit your order, you provide your credit card details. Once you have been authenticated as the legitimate cardholder, the payment transaction will be carried out automatically and your card will be charged.
Klarna PayNow credit card
When you submit your order, you provide your credit card details. Once you have been authenticated as the legitimate cardholder, the payment transaction will be carried out automatically and your card will be charged immediately after the goods have been dispatched.
PayPal
During the ordering process you will be redirected to the website of the online provider PayPal. In order to be able to pay the invoice amount via PayPal, you must be registered there or first register, identify yourself with your access data and confirm the payment instructions to us. After placing the order in the shop, we request PayPal to initiate the payment transaction. The payment transaction will be carried out automatically by PayPal immediately afterwards. You'll get more information during the ordering process.
Immediately by klarna
After placing your order, you will be redirected to the website of the online provider Sofort GmbH. In order to be able to pay the invoice amount via Sofort, you must have a bank account that is activated for online banking, identify yourself accordingly and confirm the payment instruction to us. You'll get more information during the ordering process. The payment transaction will be carried out by Sofort immediately afterwards and your account will be debited.
Purchase on account via Klarna
In collaboration with Klarna AB (www.klarna.de), Sveavägen 46, Stockholm, Sweden, we offer you purchase on account as a payment option. Please note that Klarna invoices are only available for consumers and that payment must be made to Klarna. When you purchase on account with Klarna, you always receive the goods first and you always have a payment deadline of 14 days. Financing via Klarna
In collaboration with Klarna AB (www.klarna.de), Sveavägen 46, Stockholm, Sweden, we offer you installment purchase as a payment option. Please note that Klarna installment purchase is only available for consumers and that payment must be made to Klarna.
With Klarna's financing service, you can pay for your purchase flexibly in monthly installments of at least 1/24 of the total amount (but at least CHF). 7. Retention of title
The goods remain our property until full payment.
8. Transport damage
If goods are delivered with obvious transport damage, please report such errors to the delivery person as soon as possible and please contact us immediately. Failure to make a complaint or contact us has no consequences whatsoever for your legal claims and their enforcement, in particular your warranty rights. However, they help us to be able to assert our own claims against the carrier or the transport insurance company.
9. Prices:
Our prices are Swiss franc prices and include VAT.
10. Contract language/storage
The final contract is in German. The order text is not saved by us and can no longer be accessed after the ordering process has been completed. However, you can print out your order details immediately after submitting the order.
11. Miscellaneous
We reserve the right to change the general terms and conditions at any time. These can be found in their current version at any time on by-mava.com. Use of video content/photos in which our products are visible: We may use this for commercial use.
